I spoke with Bloomberg News and Chanyaporn Chanjaroen on whether recent developments in Hong Kong will lead to more international arbitration cases being seated in Singapore. The article has also been picked up by The Straits Times and Financial Post (which feature non-paywall versions - links in comments).

To elaborate, I have no doubt that HKIAC and its appointed arbitrators will continue to seek to discharge their duties as independently and fairly as possible. However, arbitration users would be understandably concerned about what the new national security law implies. Perception has a power of its own. It is also telling that HKIAC saw a need to make a formal statement asserting its neutrality and effectiveness (https://lnkd.in/eV3eQwQ).

Ultimately, choose the forum that best suits your specific transaction or dispute. Hong Kong still offers some advantages. Speak to your lawyers about jurisdiction / arbitration clauses early - don't leave it to the final moments of negotiation!
